Given the emphasis placed on flexibility in the post-Fordist era, temporary migrant work epitomizes the drive toward casualization of labour and the pushing of jobs into marginal labour markets. Desgroseillers, le patron de la ferme, nie le fait que M. Rosas ait pu se faire cette hernie au travail et le fait qu'il gardait ses papiers. Selon Andrea Glavez et Patricia Perez, resepctivement membre et fondatrice du CATA affirment qu'il ne s'agit pas d'un cas isolé et que plusieurs propriétaires de ferme gardent les papiers des travailleurs migrants pour que ceux-ci, las d'être maltraités, ne tentent pas de fuir. C'est une attitude encouragée par la Fondation des entreprises en recrutement de main-d'oeuvre étrangère qui a affirmé, dans L'Actualité maraîchère, que les propriétaires peuvent congédier les ouvriers s'absentant du travail pour consulter un médecin sans passer par eux. Lorsqu'un travailleur est congédié, il est renvoyé du Programme pour les travailleurs agricoles saisonniers et est rapatrié dans son pays. The notion of "postnational citizenship" has been challenged by many researchers who have argued that universal principles of human rights cannot be implemented and enforced without the consent of nation-states. Although nation-states have demonstrated a certain degree of respect for universal principles, their commitment to the ideas of post-national citizenship are based on a conception of citizenship rooted in membership in a particular bound community. The two notions of citizenship--one linked to inclusive universal rights and the other to membership in an exclusive community--are at times contradictory. Using the case of Mexican migrants working in Canada, this presentation will emphasize the difference between rights as a set of principles and laws on the one hand, and their actual practice and implementation on the other. Basok will argue that whereas legal access to economic rights has been extended to non-citizens residing in the national territory of sovereign nation-states, membership in the national community has often been denied to them, thus precluding them from exercising the rights to which they have been granted legal access. Ce rapport contenait une analyse du Programme des travailleurs agricoles saisonniers du gouvernement du Canada et en énumérait les nombreux volets qui se sont révélés inefficaces et qui ne protègent pas adéquatement les droits des travailleurs migrants. Le rapport recommandait que le gouvernement fédéral apporte une série de modifications au programme afin d’en combler les lacunes. Dans l’année qui a suivi la remise de ce rapport, le gouvernement fédéral n’a pris aucune mesure visant à remédier aux nombreux problèmes que rencontrent les travailleurs agricoles migrants ou à combler les lacunes de son programme.
